1. About Blurb Motion

2. The Service
Blurb Motion creates a cinematic promotional video based on the information and creative material supplied by the customer. The service may include review of the customer's book blurb and supplied material, development of a trailer concept, selection or creation of visual material, video editing, voiceover, music or sound design, and delivery of a completed book trailer. The exact scope depends on the package purchased. Blurb Motion will use reasonable professional skill and care.3. Ordering and Payment
Payment is required in full before production begins. An order is not confirmed until payment has been successfully received. By making payment, the customer authorises Blurb Motion to begin work. Customers should ensure all information, instructions and materials are accurate and complete before production begins.4. Customer Materials
The customer may provide book blurbs, book covers, manuscript excerpts, author photographs, character descriptions, images, logos, promotional material and other written, visual or audio material.
The customer confirms they have the necessary rights, permissions and authority to provide these materials. The customer remains responsible for copyright, trademark, publicity, privacy and other rights associated with materials they provide.
5. Creative Interpretation
Blurb Motion's service involves creative interpretation. The final trailer may not reproduce the customer's book exactly as imagined. Blurb Motion may make reasonable decisions regarding visual style, scene selection, pacing, music, voiceover, typography, transitions, colour treatment and cinematic presentation.6. First Cut and Revision
Blurb Motion will provide a first cut for review. The customer is entitled to one revision at no additional charge. Requested revisions must be submitted within 24 hours of the first cut being sent. If no requests are submitted within that period, the first cut will be considered approved and the project may be treated as complete.7. Additional Revisions
Revisions after the included revision or after the 24-hour period are charged at £50 GBP per hour. Additional work may include changes to scenes, text, voiceover, music, timing, visuals, editing, story structure or other elements. Substantial changes may be treated as additional production.8. Customer Delays
Blurb Motion is not responsible for delays caused by the customer failing to provide required information, materials, approvals or feedback. If a customer does not respond within the applicable timeframe, Blurb Motion may consider the project approved and complete.9. Delivery
The completed trailer will be delivered electronically using the delivery method specified by Blurb Motion. The customer is responsible for providing valid delivery information. Estimated delivery times are not guaranteed unless expressly agreed in writing.10. Changes to the Scope of Work
Requests that materially change the original project may be treated as additional work, including changing the concept after production begins, providing substantial new source material, requesting a substantially different trailer, changing the format or purpose, requesting additional scenes, or requiring recreation from the beginning.
11. Cancellation Before Production
Because payment is collected before production begins, customers should review project information carefully. Where applicable consumer protection laws provide a statutory right to cancel, Blurb Motion will honour those rights. Cancellation requests will be considered in accordance with applicable law and the circumstances of the order.12. Cancellation After Production Begins
Once production has begun, cancellation and refund rights may be affected by applicable consumer protection laws and the nature of the digital service. Where applicable law permits cancellation, Blurb Motion will comply. Nothing removes a mandatory consumer right that cannot legally be excluded.13. EU and EEA Consumer Rights
Mandatory EU and EEA consumer protection laws continue to apply. For digital services and content, statutory rights may depend on whether performance began with the customer's express request and acknowledgement. Nothing excludes mandatory consumer protections.14. UK Consumer Rights
Customers in the United Kingdom retain mandatory consumer rights provided by applicable UK legislation. Nothing excludes or restricts a statutory right that cannot legally be excluded.15. Refunds
Refunds are handled in accordance with applicable law. Where a customer has no statutory right to a refund, payment for services already performed may not be refundable. Contact blurbmotion@gmail.com with any refund request.16. Intellectual Property in Customer Materials
The customer retains ownership of intellectual property in materials they provide, subject to third-party rights. The customer grants Blurb Motion permission to use those materials solely to provide the contracted service.17. Ownership of the Finished Trailer
Subject to full payment and third-party rights, the customer receives the right to use the completed trailer to promote and market their book, including on websites, social media, YouTube, Facebook, Instagram, TikTok, author websites, campaigns and online advertising.
Blurb Motion does not transfer ownership of third-party assets, stock footage, music, fonts, software or licensed materials.
18. Third-Party Assets and Licensing
Blurb Motion may use licensed stock footage, music, fonts, software, voice services and other production resources. Such materials may have separate licensing conditions. The customer may not represent third-party assets as their own independent intellectual property.19. Portfolio and Promotional Use
Unless expressly requested otherwise before production begins, Blurb Motion may display the completed trailer, screenshots or short excerpts in its portfolio and promotional materials. Blurb Motion will not intentionally disclose confidential information. Confidentiality must be agreed in writing before production.20. Artificial Intelligence and Production Technology
Blurb Motion may use software, artificial intelligence tools and other digital production technologies. This does not change the customer's rights to use the completed trailer. Third-party providers may have their own terms and licensing conditions.21. No Guarantee of Sales or Results
Blurb Motion creates promotional material designed to attract attention and generate interest, but does not guarantee:
- Book sales or increased readership
- Website traffic or social media engagement
- Advertising performance or publisher interest
- Reviews, downloads or any particular commercial result
Marketing results depend on factors outside Blurb Motion's control.
22. Website Use
Visitors may use the website for lawful purposes only. Users must not attempt unauthorised access, interfere with security, introduce malicious software, copy website content without permission, use the website fraudulently, or disrupt its operation. Blurb Motion may restrict access where necessary.23. Availability of the Website
Blurb Motion makes reasonable efforts to keep the website available, but uninterrupted availability cannot be guaranteed. The website may be unavailable because of maintenance, updates, technical failures, hosting issues, internet failures, security incidents or circumstances outside reasonable control.24. Limitation of Liability
Nothing excludes liability where prohibited by law. Subject to mandatory rights, Blurb Motion will not be liable for indirect, incidental, special or consequential losses. Liability is limited to the extent permitted by law. Nothing limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or liability that cannot legally be limited.25. Events Outside Our Control
Blurb Motion is not responsible for failure or delay caused by circumstances outside reasonable control, including internet or hosting failures, software outages, third-party failures, cybersecurity incidents, natural disasters, government actions, war, civil unrest, strikes and power failures. Where possible, affected customers will be notified.26. Privacy
Personal information is handled in accordance with the Blurb Motion Privacy Policy, available at /privacy-policy.27. Changes to These Terms and Conditions
Blurb Motion may update these Terms and Conditions. The updated version will be published on this website and the “Last updated” date changed. Changes will not affect accrued rights unless permitted by law.28. Governing Law
These Terms and Conditions are governed by the laws applicable to Blurb Motion, subject to mandatory consumer protection laws. Nothing removes rights available under mandatory legislation in the customer's country of residence.29. Disputes
Customers should first contact blurbmotion@gmail.com. Blurb Motion will make reasonable efforts to resolve complaints directly and amicably. Nothing prevents a consumer exercising mandatory rights.30. Severability
If any provision is invalid, unlawful or unenforceable, it will be modified or removed only to the extent necessary. The remaining provisions continue to apply.31. Entire Agreement
These Terms and Conditions, together with any specific written agreement or service description, constitute the agreement between Blurb Motion and the customer. A specific written agreement takes precedence where there is a conflict.32. Contact
